2. Personal Data Collected

Your personal information will be used to provide the services and information you have requested, inform you about changes, and evaluate the quality of the service we provide.

For the purposes mentioned above, we require the following “Personal Data”:

General data: First and last name(s), landline (home or office), mobile phone, company name, email, and other similar data concerning a person.
Employment application data: When you provide personal data through Innova3’s job board, in addition to general data, personal information will include details such as educational level, work experience, and any information related to the résumé you submit.
Social Networks: Social networks (such as Facebook and Twitter, among others) constitute a platform of communication and interconnection between users. They are unrelated to Innova3 and, therefore, are not under its responsibility. Information you provide on social networks in which Innova3 participates as a user does not constitute nor is considered part of the Personal Data subject to protection under this Privacy Notice, being the responsibility of the platform provider and the individual posting it.

The aforementioned Personal Data will be collected through forms and/or by collecting information or documentation required by Innova3, either in person or electronically on the website: www.innova3.com.mx

3. Processing of Personal Data

According to the Federal Law on the Protection of Personal Data Held by Private Parties, the processing of Personal Data includes obtaining, using, disclosing, or storing personal data by any means. Usage includes any action of access, management, utilization, transfer, or disposition of personal data.

The processing of personal data by Innova3 will be limited to fulfilling the purposes of processing stated in this Privacy Notice and will be subject to the following:

Obtaining consent: If personal data is to be processed for a different purpose, Innova3 will obtain your consent.
Adequacy: Processing will be necessary, adequate, and relevant for the purposes described.

4. Purposes

Through this Privacy Notice, Innova3 declares that the purposes of processing your Personal Data are as follows:

Compliance with client obligations: To follow up on quotation requests, provide information about our services, monitor service delivery, billing, or collections.
Recruitment and personnel selection: To provide information about job vacancies and offers, and respond to applications.
Follow-up on complaints and suggestions.

5. Acceptance

For Innova3 to process Personal Data, data subjects must provide their express or tacit acceptance through the following means:

5.1 Acceptance via electronic means

Email: Sent to the email provided by the data subject, including a link for acceptance.

5.2 Acceptance or rejection by electronic means

Acceptance or rejection of Innova3’s Privacy Notice by electronic means will occur as follows:

a) Innova3 will send to the registered email address:

Notice of the existence of Innova3’s Privacy Notice or any modifications to it.
The content of the Privacy Notice and, if applicable, updates.
A link to accept or reject the Privacy Notice or its amendments.

b) Once you have read the Privacy Notice or its amendments, you will have the following options:

Accept: By accepting, you provide consent and authorization for Innova3 to use your Personal Data in accordance with the purposes established in this Privacy Notice.
Do not accept: If you reject the Privacy Notice or its modifications, you deny or revoke your consent for Innova3 to use your Personal Data. In this case, Innova3 will cancel and stop using your data for the purposes established.

5.3 Personal acceptance

When personal data is collected directly, Innova3 will provide this Privacy Notice clearly at the time the data is collected, through forms used for this purpose. These forms will also include acceptance or rejection of consent.

5.4 Tacit acceptance

Based on the Law, if you do not object to the content and scope of this Privacy Notice or its amendments within 2 months after being notified by Innova3 through any of the means described in 5.1, you will be deemed to have granted tacit consent for Innova3 to process your Personal Data.

5.5 Retroactive acceptance

For all clients who provided Personal Data prior to the notification or publication of this Privacy Notice, it will be communicated according to 5.1 for express or tacit acceptance.

6. Limitation on Use or Disclosure

If you wish to limit the use or disclosure of your Personal Data provided to Innova3, you must submit a written request to sgc@innova3.com.mx or to Innova3’s address, specifying:

Name of the data subject.
Identification of the data subject.
Contact method for response.
Clear description of the Personal Data subject to the requested limitation.

7. ARCO Rights (Access, Rectification, Cancellation, Opposition)

Under the Law, you have the right to access, rectify, cancel, or oppose the processing of your Personal Data. Innova3 provides the following contact methods for submitting requests:

7.1 Request for ARCO rights

Requests must include:

Full name and address of the data subject.
Documents proving identity or legal representation.
Clear description of the Personal Data and the right to be exercised.
Any additional element to locate the data.
Proposed modifications or limitations.
Supporting documentation.

7.2 Resolution and communication

Innova3 will notify the resolution within 20 business days from receipt of the request. This may be extended once for another 20 business days if justified.

If accepted, the request will be executed within 15 business days after the resolution is communicated.

If the request is denied, the reasons will be provided.

Data subjects may also file a request for data protection with the National Institute for Transparency, Access to Information and Personal Data Protection (INAI, formerly IFAI).

7.3 Grounds for denial

Innova3 may deny access or modification if:

The applicant is not the data subject or representative.
The data is not found in Innova3’s database.
Third-party rights may be affected.
Legal restrictions exist.
The requested action was already performed.

8. Changes to this Privacy Notice

Cancellation will result in a blocking period after which data will be permanently deleted, except where retention is legally required.

9. Transfer of Personal Data

Innova3 reserves the right to modify or update this Privacy Notice at any time in response to legal changes, internal policies, new services, or commercial practices. Changes will be communicated through the means described in section 5.

10. Final Considerations

Innova3 may transfer Personal Data to its suppliers to fulfill the purposes stated in this Privacy Notice, provided confidentiality agreements are signed and recipients agree to abide by this Notice, unless exceptions under Article 37 of the Law apply.

If you do not object, you will be deemed to have consented to such transfers.
